Why this label
The claim was accurate when the decision issued. EPA's own page says the February 2020 interim decision found glyphosate unlikely to be a human carcinogenS2. The decision was challenged in the Ninth Circuit in March 2020. In June 2022 the court vacated the human health portionS2. In September 2022 EPA missed a court deadline on the ecological portion and withdrew the interim decisionS2. EPA says the withdrawal does not by itself mean its scientific findings are wrong, and it still cites its 2017 assessmentS2. The 2020 interim decision no longer stands as a decision, so a reader citing it as current EPA policy would be relying on a superseded record.
Current procedural position
Human health portion vacated by the Ninth Circuit in June 2022. Interim decision withdrawn by EPA in September 2022. Updated human health risk assessment anticipated in late 2026 as of 26 August 2026S2.
Record supporting the assessment
The Ninth Circuit vacated the human health portion of EPA's ID.
EPA was unable to finalize a new ecological portion by the court-imposed deadline and withdrew the glyphosate ID.
Conflicting or limiting record
unlikely to be a human carcinogen
Evidence score: 86 of 100
The score grades how well the record establishes this assessment. It is not a score of Bayer AG. Score = source authority + directness + corroboration + procedural accuracy + currency + reproducibility.
| Component | Points | Max | Reason |
|---|---|---|---|
| Source authorityIs the source competent to establish the proposition? | 27 | 30 | EPA is the competent regulator and describes its own decision history. |
| DirectnessDoes the source state the proposition or only discuss adjacent facts? | 19 | 20 | The page states the vacatur and the withdrawal in plain terms. |
| CorroborationDo independent records support the same material point? | 9 | 15 | The Ninth Circuit ruling itself was not read, so the record rests on EPA's account. |
| Procedural accuracyDoes the record settle the procedural state the claim describes? | 12 | 15 | The vacatur and withdrawal are settled, but the replacement decision is pending. |
| CurrencyHas the record been checked against later developments? | 10 | 10 | Checked against the EPA page updated 26 August 2026. |
| ReproducibilityCan a reader locate the passage and repeat the assessment? | 9 | 10 | The EPA page is public. |
| Total | 86 | 100 |
