Why this label
Shell's position is reported by ReutersS6. The Hague Court of Appeal ruled on 29 January 2021 that sabotage must be shown beyond any reasonable doubtS5. For Oruma and Goi it did not accept that standard was met and held Shell Nigeria liable for the leaks. For Ikot Ada Udo the court said sabotage had been established, and it left open whether Shell could still be liable. So the court record agrees with Shell on one site and does not accept Shell's account on two. Leigh Day says Shell blames much Niger Delta pollution on illegal activity such as oil theftS4. This record does not test that wider view. The Bille and Ogale claims will test related arguments at a trial in 2027S4.
Current procedural position
Final Hague Court of Appeal ruling of 29 January 2021S5. Settled by Shell for EUR 15 million on 23 December 2022 with no admission of liabilityS6.
Record supporting the assessment
