Prosecutors who appealed to the STF in 2023 and 2024 took the position that evidence from Odebrecht's leniency systems remains usable in Brazilian proceedings.

Why this label

The STF press office reported on 6 September 2023 that Justice Dias Toffoli declared all evidence from the Drousys and My Web Day B systems void, in any sphere or level of jurisdiction^S2. That is the opposite of the proposition that the evidence stays usable. Earlier decisions had done the same for single defendants, such as a June 2023 ruling in Petição 11.421^S4. The Federal Public Ministry, the São Paulo state prosecutors and a prosecutors' association appealed. The STF Second Panel postponed the appeals in February 2024 to await the leniency renegotiation in ADPF 1051^S5. We found no later record that reversed the September 2023 decision. If the appeals succeed, this label would need review.
